Jury selection was set to begin Monday in the case against Rudy Rubio -- who is accused of sexual assault, but that's been delayed and here's why.

Rubio is the local auto repair business owner accused in the sexual assault of a woman in September of last year.

He was arrested last October and charged with aggravated kidnapping and sexual assault but was released after posting bond.

He was re-arrested after failing to comply with the conditions of his release because he tested positive for alcohol and drugs.

But now he's asked the court for hair follicle test to be done on the victim in the case.

The trial is now set to start on September 5th.

If found guilty, Rubio faces up to 99-years in prison.
