A 70-year old Corpus Christi attorney is in the Nueces County Jail after failing a drug test while in court on Friday.

However, while waiting to be taken to jail, Daniel "Dan" Barber was arrested for drug possession after authorities say he tried to remove what appeared to be cocaine from his coat pocket. Then, he slumped over his seat in court.

Barber was then transported by EMS to the hospital from the 117th district court after complaining of chest pain.

"They called an emergency crew from the fire department to take care of him. He thought he was having some heart trouble," said Les Cassidy, Barber's attorney.

Barber was in court Friday for a docket call in preparation for a trial set for Tuesday, where he is facing two counts of possession of a controlled substance. Now the Corpus Christi lawyer will have to face additional charges.

This is not Barber's first run in with the law. He is also facing a misdemeanor DWI and two more drug charges. He also has outstanding cases in San Patricio County.
