GREGORY--A family of a small child who authorities say died from child abuse are frustrated the case hasn't been presented to a grand jury. They said the people responsible for the death of little Justin Fellers are walking around free and there's been no justice

Closure is never easy for a family in this situation. They want to see somebody indicted for causing the death of the two year old child.

The family of Justin Fellers visit the cemetary to pay their respects on a weekly basis. They said last November, he died at a home in Gregory.

His family said he was living there after a judge gave custody to his father, Bryan Fellers. An autopsy shows Justin Fellers had several bruises all over his body and died from blunt force trauma. It also states his death was a homicide.

Martha Vasquez, Feller's girlfriend, was charged with child endangerment, but no one else is in trouble because those who lived there aren't talking to investigators. So the Fellers family is upset that no one is facing any serious criminal charges.

"It's not my job to figure out who did it?," said Vicky Poulin, who is Justin Feller's grandmother. "It's the DA's job to figure out. It' been four months. They just keep letting them walk around free. They're working. They're having their holidays with Martha's daughter. Where's Justin? Where's Justin? Justin is in the grave. This is where we have to come celebrate Justin."

We talked to the Gregory Police Chief. He said he turned in his report about a month ago to the District Attorney's office and they're waiting for a decision on who will be charged? We called the District Attorney's office to ask them questions, but they didn't return our calls.

The San Patricio County Grand Jury is expected to hear evidence on this case next Tuesday. After that, the family hopes they can get Justice for Justin and get some criminal charges against those responsible for his child abuse death.
