A municipal court judge Monday told a pet owner she's very lucky her dog didn't die in a hot vehicle..Calling the owner's choice to leave the dog locked in the car as cruel confinement.  And, as a result that same judge upheld an animal seizure warrant and awarded custody of the pup to the city....Meaning soon it'll be available for adoption.  Three news has been following this story. 

Monday's hearing was an opportunity for  Loraine Martinez to get her dog back. She tried representing herself.  She took the stand and told the judge she loved her dog named Tex. 

Loraine Martinez quickly got in a friend's car, dodged our camera and our questions following the hearing.  She told us inside the courtroom she didn't want to speak with us because quote "We had humiliated her, and her sons."

We were there on July 9Th, and saw her dog yelping and rapidly panting from the inside of her uncle's SUV. According to police she left the animal for at least thirty minutes while she went inside a store in Moore Plaza. She said she was looking for her uncle who was shopping. We later confronted her after concerned citizens called 9-1-1 and police had to break into the locked vehicle to rescue her dog.

She questioned the city's witness,  Animal Control Services Community Education Officer, Dennis Noble asking him when it became illegal to leave dogs in cars, and asked aren't dogs able to tolerate heat better than humans. That's not the case, in this type of heat this is considered cruel confinement. 

The judge agreed with animal control and a city prosecutor that Ms. Martinez might love her dog, but leaving an animal in a locked car is cruel confinement as if leaving them to cook in an oven. The dog is now the property of the city, and will be available for adoption after it goes through heart worm tests.  If it tests negative then it'll be available to go to a new home.  

 The temperature outside is different than the inside of the car. For instance, the average temperature on Monday was 97 degrees...after just 15 minutes even if the windows are cracked the temperature inside of a car, rises some 30 degrees.

What a cute little guy! How would she like to be submitted to this heat? At least leave the vehicle locked,running with air conditioning on-but not for long either!!Was she too cheap to waste gas on her precious buddy?I have ran into a corner store, vehicle parked,air conditioning running and locked to get something.My vehicle is parked right in front of the corner store I am in.I am immediately out.To leave a precious buddy inside a hot car, then leave him home where he is safe and cool.Wise up

Thank GOD the judge takes this seriously! Corpus is the worst for ignorant and just plain stupid pet owners. That woman Loraine Martinez should be ashamed of herself. She should have her fat self locked in a car to suffer heat stroke. She is a complete IDIOT with no judgement and no brain! Too bad her address and phone number are not posted anywhere.

i am glad her dog was taken i wish congress would start doing background checks to see if a person wanting to adopt a dog,cat,etc. is in her or his right mind to take on the responsablity to care for dogs,cats,etc. instead of ending up with someone who has no heart,no brains,and is a complete heartless moron here's hoping that tex finds the right home to spend his remaining years in happiness and peace which every dog and cat really,truly deserves

This woman claims she was humiliated by three news? She embarrased herself! Crystal M is right. She defended herself? She could have gotten the dog back? Last I heard they were going to sentence her to never own another dog! If she's this irresponsible, I can't imagine her ever caring for the dog in the first place. Thank GOD for those who called 9-1-1. At least SOMEONE is speaking up for the injustice that poor dog had to suffer. In earlier news they stated it was more like forty minutes she left the dog without air or water in a car with barely cracked windows. I'm glad she lost Tex. I hope someone more responsible is allowed to care for him since his previous owner was unable to differentiate human skin and dog fur regarding heat exposure. Three news reported earlier you can bake cookies in a car! Hello?

I can't imagine what she was thinking to leave her supposedly loved dog in a car to pant and become incapacitated by the emerging sweltering heat!If the temperature raises only thirty degrees in fifteen minutes...that means that it was over a hundred and twenty degrees!What was she thinking!!!My car has no AC and I can't imagine sitting for even five minutes without rolling my windows all the way down.WOW!They nailed it on the head:IGNORANCE! I have reported dogs left in cars before. You just can't do that in our kind of heat. What a terrible punishment it is to the dog. It is very common for kids and dogs to die in this kind of situation. Hope she never gets this darling dog back. IF she seemed surprised at this then I doubt if she will ever learn.

The woman claims Channel 3 humiliated her sons, but I say SHE HERSELF humiliated them by using bad judgment and inflicting abuse upon her dog by leaving in a hot oven car! What kind of an example, as a mother, is she setting for her sons? Sounds like she's not wanting to take responsbility for her own bad decisions. If anyone has caused embarassment to her sons, it is herself Sounds like a woman that never owns up to her mistakes. Poor sons. I pity them. But I no longer pity that dog.

I can! What a fool and a dumb idiot to leave a helpless, defenseless animal in the car with triple digit temps! The dog could have died! How would she like it if she were left in a car and had only cracked windows for air! She would be sweating like a pig, and by the way, she looks like one herself--hey, maybe she SHOULD be left in a hot car without air and maybe she'd lose some weight! That's an idea! She looks like she could stand to lose at least 100 lbs! I hope someone responsible gets it
