This week the 13th Court of Appeals in Corpus Christi will be hearing an interesting legal battle that has already made national headlines. The case involves the transgendered widow of Wharton County firefighter Thomas Araguz who died back in 2010 fighting a massive fire. His wife Nikki, has spent the last 3 years in a court battle with Thomas' family over the legitimacy of the couples marriage. The couple married in 2008. At stake, close to half a million dollars in benefits.
Here's the issue, the family says because Nikki was born as a boy rather than a female she should be denied those benefits. In 2011 a state district judge ruled in favor of the fire fighter's family and nullified the marriage. Nikki is appealing that decision here in Corpus Christi Local LGBT activists plan to show their support and draw attention to the issue of marriage equality.
On Tuesday Nikki will be speaking about her court battle at the Unitarian Universalist Church on Holly Road. It starts at 5:30pm. Then on Wednesday during the hearing, a rally will be held outside the Nueces County Courthouse.
