Court Bailiff Takes The Stand In Assault Trial

A Corpus Christi man who was about to go on trial for allegedly assaulting an elderly woman a year ago, is now on trial for another assault.  This time, the alleged victim was a court bailiff.

Dan Arispe was on the stand telling jurors what happened that day in July 2011 as he was  in the courtroom with Lionel Guerrero.

Guerrero is accused of attacking the man in front of the judge and a courtroom full of attorneys and spectators.

Tuesday, on the stand the bailiff told jurors his knee was shattered during the scuffle.

"I felt my knee pop and I didn't want him to know I was injured at the time.  For my security, I didn't want him to know that he was going to overpower me at the time.  So, I didn't want you know him to know that I was hurt.  Grabbing him I started getting up.  We both started getting up slowly trying to drag him back up when he started pushing more so I put his shirt over his head.  That's when I dragged him out to the hall," said Arispe.

The assault of a public servant is a third degree felony which if found guilty could land Guerrero in prison for up to 10 years.
