Officer Reinstated After Civil Service Hearing

A civil service hearing was held Thursday at the Nueces County Courthouse to discuss the career of a Nueces County constable deputy in Precinct 5.

A witness at the hearing said he saw Constable Sergeant Edward Day turn in his badge. Day was said to be upset when a supervisor reportedly asked him to dismiss a ticket that one of his officers handed out.

Day said that was illegal and refused. His bosses said Day turned in his badge and resigned, but Day said what he really did was turn in his badge and ask for a demotion.

Thursday's hearing was to determine if Day could keep his job.

"Basically, I was given an order I thought was unethical and illegal," Day said. "And I didn't want to carry it out. The only thing I saw to get out of that situation was to resign as a sergeant so that I couldn't be in a position to order an officer to do something I thought was wrong."

In the end, the panel decided Day should be reinstated as a sergeant and receive pay for all the time he missed.
