Defendant Opts Out of Plea Deal in New Capital Murder Trial

CORPUS CHRISTI (Kiii News) -

After asking for and getting a new trial, halfway through Monday's testimony, 23-year old Carlos Gonzales opted out for a plea deal.

Gonzales was being retried for capital murder after his life sentence was overturned. It was in 2008 that Gonzales, along with Pablo Padilla, was convicted of robbing and killing 22-year old Victor Morales.

Gonzales pled guilty to a lesser included offense of felony murder. He has been sentenced to 40 years prison time. He will be getting credit of just over 500 days for time already served in prison, but will have to serve at least half the 40-year term before becoming eligible for parole.

His accomplice, Padilla, is currently serving a life sentence.
