Arrest Affidavit Details Allegations Against Former Driscoll Police Chief

ROBSTOWN (Kiii News) -

More details have come to light in the wake of the arrest of former Driscoll Police Chief Ben Zapata, who faces a felony charge of retaliation.

The 58-year old's common law wife said that he assaulted her back on April 6.

Zapata, who is now a precinct 5 constable deputy, was arrested Monday after Robstown detectives investigated the incident.

The arrest affidavit complaint notes that Zapata allegedly "punched the woman in the mouth with a closed fist, causing a cut and bleeding to her lip." Also in the affidavit, the investigating officer noted that the victim told him that Zapata said "he would killer her" as she packed up her things.

On Tuesday, Zapata's current employer, Precinct 5 Constable Frank Flores, said Zapata is on vacation.

"Right now the case is being investigated by the Robstown Police Department currently," Flores said. "I'm not going to rush into judgement, you know. I'm going to wait to see until I get that report in front of me, so I can make an administrative decision to see what I'm going to do with the officer."

This is not Zapata's first run in with law enforcement. Back in January, Zapata faced a charge of threatening to harm a family member, which was later dropped.

Zapata was released from the Nueces County Jail after posting a $25,000 bond.
