The brother of the man who was killed by a local convenience store owner after reportedly trying to steal beer from his store spoke to 3News on Wednesday.David Garcia, 39, was shot by 52-year old Rodney Duve Saturday night after allegedly running out of his store with stolen beer.Duve has been charged in his murder, and posted bail Sunday. He was released late Tuesday on the condition that he wear a GPS ankle bracelet."I just want justice, because that wasn't right, him shooting my brother like that," said Hector Garcia, the victim's brother.Garcia said his family is taking the loss of his older brother very hard. Their mother, a seriously ill diabetic, is crushed. Their father, a Vietnam veteran is also taking his son's death very hard.Garcia had reportedly made a beer run earlier in the same night, and then returned to the store to make a second run. Hector said his brother had run-ins with the law all of his life."Yeah, he had trouble all his life.
