When is it Okay to Use Deadly Force?

Monday morning's incident in which a Country Club homeowner shot an alleged burglary on his property begs the question: When is it okay to use deadly force?

3News asked Nueces County District Attorney Mark Skurka to clarify.

He said the main condition is that you have to believe your life or the life of someone else in the home is being threatened. However, there are some other factors.

"The legislature has changed the law to now say it is presumed to be immediately necessary if someone is attempting to break into your home, has broken into your house or your car or business," Skurka said. "You can use deadly force to repel that, if all the other circumstances exist."

Skurka said that does not mean you can shoot someone as they are running away or if they are simply trespassing. Cases are usually left to a Grand Jury to decide.
