Dimick Found Guilty of Aggravated Kidnapping, Mistrial on Second Count

CORPUS CHRISTI (Kiii News) - Jurors read a verdict in the trial of Eric Dimick Friday morning, finding him guilty on the first count of aggravated kidnapping for his role in the 2012 kidnapping and sexual assault of an 11-year old girl.

However, after much deliberation before and after breaking for lunch, the jurors could not reach a unanimous verdict on the second count of aggravated sexual assault of a child and a mistrial was declared.

The guilty verdict was handed down just after 10 a.m. in the 319th District Court. Judge David Stith ordered the jurors to continue deliberating on the second count, asking that they come to a decision by lunchtime. That did not happen.

Following the break for lunch, jurors were told to continue deliberating. Eventually, the jurors were asked if allowing them more time to deliberate would help them come to a unanimous verdict. Their response was no.

Judge Stith officially declared a mistrial for the second count at around 2:30 p.m. There will be a retrial for that count at a date to be determined later.

Meanwhile, the prosecutor told the judge that she will have five witnesses to present during the punishment phase of the trial, and the defense said they will have five or six. Punishment phase will begin at 9 a.m. Monday.
