The trial of the former Driscoll police chief, now Precinct 5 Deputy Constable Ben Zapata, continued in county court on Thursday.
Zapata faces a felony charge of retaliation in connection with the alleged assault of his common law wife. Specifically, Zapata, who is 58 years old, is accused of "punching her in the mouth" and cutting her lip.
Zapata was arrested back in April.
The investigating officer said the victim, Oralia Cuellar, also accused Zapata of threatening to kill her as she packed up her belongings to leave.
However, on Thursday, Cuellar told prosecutors that the incident stemmed from a typical "couples disagreement" that got out of hand.
If found guilty, Zapata could face up to a year in jail and/or two years probation.
