Falfurrias alderman Aaron Trevino fails drug test, now faces a possible jail sentence if convicted of DWI

The alderman was stopped back in April 2023 and 3NEWS was told that he has violated the terms of a pre-trial diversion program.

CORPUS CHRISTI, Texas — Falfurrias city alderman Aaron Trevino could have had his DWI charge dismissed if he had successfully completed a pre-trial diversion program. However, Brooks County officials say that didn't happen and now the council member could face the maximum penalty he can receive under the law.

On April 8, 2023, Trevino was stopped by Falfurrias police for a DWI. Trevino ended up eventually agreeing to go through a pre-trial diversion program which would have wiped that DWI off the books, but County Attorney David Garcia told 3NEWS he failed a drug test after he tested positive for alcohol. 

Now, Trevino is out of the program and is under bond supervision and facing possible jail time. 

"I'm not talking about this case, but typically it's going to involve a much longer period of probation, it's going to involve some jail time," Garcia said. "The probation is important because there are a number of classes and we have a situation where we also use AA and things that are going to remedy the situation."

3NEWS obtained the police report of Trevino's DWI stop. A Falfurrias officer said they noticed that Trevino had driven his car past a stop sign before stopping and then backing up. The officer pulled him over and says when the alderman was asked where he was coming from Trevino supposedly said a nearby bar and that he had only had a drink. The officer suspected the alderman was drunk and called in a DPS trooper to take over the case.

"This officer said he thought it would be a conflict of interest just because this was a councilmember and he worked for the city and he didn't want any animosity or anything negative, so he called the troopers from there they took the case," Police Chief Will Barton said.

Officials told 3NEWS Trevino was given a breathalyzer on the scene and failed it. He was then taken to Spohn Kleberg for a blood test and that supposedly showed he was above the legal limit of intoxication. 

3NEWS contacted Trevino for comment about his failure to be able to complete the pre-trial diversion program. He said that he was unaware that he had failed any drug test and was now seeking legal council.
